Welcome to Kashmir Holidays Co. By booking any tour, travel service, or itinerary with us, you (“Client”, “Traveler”, “Customer”) agree to be legally bound by the following Terms & Conditions.

Please read them carefully before making any booking.

1. Company Role & Liability Disclaimer

Kashmir Holidays Co (“we”, “us”, “our”) acts as a tour operator, travel facilitator, and booking agent.
We arrange services such as transport, hotels, houseboats, sightseeing, guides, and activities through third-party suppliers.

We are not responsible for:

  • Any loss, injury, damage, delay, accident, or irregularity caused by a third party.
  • Acts of nature (weather, snowfall, landslides, floods, roadblocks, etc.).
  • Political disturbances, strikes, curfews, government restrictions, or sudden itinerary changes beyond our control.
  • Loss or damage to baggage, personal belongings, or valuables.
  • Health issues, medical emergencies, or lack of travel insurance.

All services are provided as available, and participation is at the traveler’s own risk.

2. Booking & Payment Policy

Kashmir Holidays Co reserves the right to cancel any booking due to incomplete payments.

A booking is considered confirmed only after we receive the required advance payment.

Full payment must be made within the timelines communicated in your package details.

Prices may vary due to fuel charges, hotel availability, seasonal surcharges, tax changes, or other external factors.

3. Cancellation, Refund & Rescheduling Policy

Customer-Initiated Cancellations

Cancellations during peak season or blackout dates.

Cancellation charges apply as per the package terms shared at the time of booking.

No refund for:

No-show, delayed arrival, or unused services.

Last-minute cancellations due to weather or personal reasons.

Company-Initiated Changes

In case of unavoidable circumstances (weather, safety concerns, political conditions, etc.), we may:

  • Modify, reschedule, or cancel the itinerary.
  • Provide an alternative of similar value.

Refunds (if any) will be processed only when received from service providers and may take 10–21 working days.

4. Travel Documents & Traveler Responsibility

Customers are solely responsible for:

  • Providing accurate information during booking.
  • Carrying valid ID proofs, permits, tickets, and travel documents.
  • Following local laws, hotel policies, and safety guidelines.

We are not liable for denial of services due to missing documentation or non-compliance.

5. Health, Safety & Risk Acknowledgement

Travel in Kashmir may involve risks due to terrain, weather, and political sensitivity.
By booking with us, you acknowledge that:

  • You understand all risks involved.
  • You will follow safety instructions from guides, drivers, and authorities.
  • You are physically fit to undertake the travel.

Kashmir Holidays Co is not responsible for injuries, health issues, or loss arising from adventure activities (skiing, trekking, gondola rides, snow activities, etc.).

6. Hotel, Transport & Activity Policies

  • Hotel check-in/check-out times follow hotel rules.
  • Vehicle service is available for point-to-point travel only, not for unlimited roaming.
  • Any additional sightseeing, changes, or detours may attract extra charges.
  • Activities such as gondola rides, pony rides, rafting, skiing, etc., are not included unless specifically mentioned.
  • We are not responsible for:
    • Hotel upgrades or room allocation decisions.
    • Cleanliness or service issues caused by hotel staff.
    • Transport delays due to traffic, checkpoints, weather, or road conditions.

7. Force Majeure

We are not liable for delays or cancellations caused by events outside our control, including but not limited to:

  • Natural calamities
  • Political unrest or security issues
  • Government orders
  • Flight cancellations or delays
  • Road closures, strikes, or riots

No refunds will be provided under force majeure situations.

8. Photos & Media Usage Consent

By traveling with us, you grant Kashmir Holidays Co permission to use photographs or videos taken during the tour for marketing purposes, unless you inform us in writing otherwise.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount actually paid by the customer.
  • We are not responsible for indirect, incidental, or consequential damages.

10. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of India.
Any dispute shall be resolved exclusively in the courts of Srinagar, Jammu & Kashmir.

You acknowledge that you have read, understood, and agreed to these Terms & Conditions.
